Terms and Conditions
This English version is an automatic translation of the original German Terms of Use and is provided solely for convenience and informational purposes. In the event of any discrepancy, ambiguity, or inconsistency between the language versions, the original German version shall prevail and be legally binding.
1. General Information
Welcome to Edkimo. Educators use Edkimo to improve their teaching and further develop their schools. Its use can also be applied to other areas and teaching and learning contexts.
Edkimo is developed and provided by Edkimo GmbH, Hauptstraße 37, 10827 Berlin, Germany (hereinafter “Provider”).
These Terms and Conditions (hereinafter “T&C”) govern the use of Edkimo. They apply to both the free and optional paid add-ons of the Edkimo app, as well as the optional mobile Edkimo apps for Android and iOS devices (hereinafter collectively referred to as the “Edkimo app”).
By using the Edkimo app, you expressly accept these Terms and Conditions.
2. User Registration
You are a user of the Edkimo app if you have a personal account to conduct surveys, create questionnaire templates, or analyze results. During registration, we collect your first and last name, a verifiable email address, your ZIP code, and, optionally, the region in which you intend to use Edkimo.
3. Free Use of the Edkimo App
After registration, the Edkimo app is available to all users free of charge for a limited time with full functionality (trial account). Trial accounts do not renew automatically. They do not require cancellation. After the limited-time trial period expires, the Edkimo app remains available for free but with limited functionality.
We reserve the right, at our sole discretion, to modify, restrict, or completely discontinue—in whole or in part—the free features of the Edkimo app and the duration of the trial period at any time.
4. Paid Use of the Edkimo App
There are two ways for users to purchase the paid versions:
- Automatic upgrade within the account: The user selects the option for a paid upgrade within their account and chooses either a monthly or annual subscription. As part of the payment process, the provider instructs an external payment service provider to process the payment details and payment method entered by the user, e.g., via credit card, PayPal, or Sofort Überweisung (Klarna). The upgrade takes place immediately and automatically. The person who placed the order then receives an invoice via email from the external payment provider.
- Upgrade by the provider: The user or an authorized representative requests a non-binding quote from the provider in advance or instructs the provider directly to issue an invoice. After the quote is confirmed (via email or phone), Edkimo performs the upgrade, followed by invoicing. Payment is typically made via bank transfer 14 days after the electronic invoice is sent. If you request a quote or make a payment to Edkimo, we will need your billing information, such as the billing address and the contact person’s email address. The details of the offered, contractually agreed-upon services are governed by the product and service descriptions provided at the time the contract is concluded and are listed in the service description in your account (automatic upgrade) or in the quote and invoice (upgrade by Edkimo).
Edkimo GmbH reserves the right to suspend a contract or block access to the Edkimo app if payment is more than 30 days overdue.
5. Right of Withdrawal
Users or persons authorized by them have the right to withdraw their consent to the offer within 14 days without providing a reason. To exercise the right of withdrawal, send an email or a letter to the provider informing them of your decision (Edkimo GmbH, Hauptstraße 37, 10827 Berlin, Germany, Email: support@edkimo.com). If payments have already been made, the provider will issue a refund.
6. Prices
Unless otherwise agreed upon, e.g., in framework agreements, the pricing details are set forth in the Edkimo GmbH price list in the version valid at the time the contract is concluded.
All prices are gross prices. For business customers (B2B) within the European Union but outside of Germany, value-added tax (VAT) is calculated according to the “reverse charge” principle. This requires the submission of a valid European tax identification number (VAT ID). We will verify the accuracy of the tax identification number before sending the invoice.
7. Contract Term and Termination
The term of upgrades in the account is automatically extended by the selected billing period (month or year) and can only be managed and, if necessary, canceled by the user within the account.
There are two models for upgrades provided by the provider.
Subscription Model: Edkimo renews automatically. Users can cancel their subscription up to one month before the end of the term; otherwise, we will issue an invoice for the additional term, which is typically one year.
License Model: Edkimo does not renew automatically. We will contact you well in advance of the end of the term, and you will confirm the renewal for another year by phone or email. Only then will we issue the invoice. Users or their designated representatives choose one of the two models when accepting the offer. Switching between models is possible.
8. Availability and Limitation of Liability
The Edkimo app is generally available at all times. However, the provider makes no guarantee.
The Edkimo app is made available to users on a non-exclusive basis. Users may not reproduce, copy, or modify the software.
The provider assumes no liability for malfunctions of third-party services (e.g., hosting services) or for damages or restrictions on use resulting from unforeseeable external events, such as fire, flooding, earthquakes, police investigations, power outages, or Internet disruptions.
9. Trademarks, Intellectual Property Rights
Edkimo is a registered trademark of Edkimo GmbH.
10. Privacy Policy
The Edkimo Privacy Policy governs the collection, processing, and use of your personal data in connection with your use of the Edkimo app. By using the Edkimo app, you consent to the processing of your data.
11. Amendments and Additions to the Terms of Use
We reserve the right to expand or modify our Terms of Use to cover new services and features. Changes to the Terms of Use will be published in advance on this website to give users sufficient time to review these changes.
By continuing to use the app after the changes take effect, you acknowledge and accept them.
12. Final Provisions
Should any provision of these Terms of Use be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
The place of jurisdiction for disputes arising from or in connection with these Terms of Use is the registered office of Edkimo GmbH (Berlin).
